TERMS AND CONDITIONS OF THE Milliplein® PROGRAM

The Milliplein program is offered by Fernand Dufresne Inc. By creating an account to participate in the Milliplein Program (the “Program”) and using the Milliplein Card assigned to you, you (“You” or the “Member”) confirm your acceptance of the terms and conditions governing the Program (the “Terms and Conditions”). Under the Milliplein Program, each Member earns reward units in the form of Milliplein Reward Points (“Points”) with eligible purchases from participating partners in the Program. Members may redeem their Points for free gasoline or for products and services at participating partners.

Except as specifically provided in these Terms and Conditions, the rights and obligations of the Member will continue to be subject to the other terms and conditions of sale of the participating partners’ products and services and those set forth in Fernand Dufresne Inc.’s privacy policy. You declare that you have read these other policies and agree to be bound by the other terms and conditions. Notwithstanding the foregoing, the specific provisions of these Program Terms and Conditions take precedence over the provisions of other Fernand Dufresne Inc. policies or other terms and conditionsPLEASE READ THE TERMS AND CONDITIONS CAREFULLY BEFORE YOU PARTICIPATE IN THE PROGRAM.

1) Enrollment and eligibility

Opening an account: To participate in the Program, you must enroll by opening a Milliplein account. The Milliplein account can be opened online at milliplein.com or in person at participating Program partners who allow enrollment. A person wishing to open an account in person with a participating partner must provide certain information, including their first and last name and a valid email address. However, the Member must complete a full enrollment profile on milliplein.com in order to redeem Points at a later date. Anyone wishing to open an online account on milliplein.com or through any of the Program's software applications must complete the full enrollment profile.

Eligibility: To be eligible to enroll in the Program and become a Member, a person must be at least fourteen (14) years of age. Enrollment in the Program is free of charge and no initial purchase is required upon enrollment.

Enrollment in the Household Plan: Individuals of the same family, living at the same address can enroll in the “Household Plan.” To be eligible, the main Member must first open an account and then add the members of his or her family residing at the same address, forming a Household Plan. All Members of a Household Plan earn their rewards together, which then can be redeemed by any one of them.

Card, account, and password: At the time of enrollment, each Member will be issued a Milliplein card with a unique number and numeric identifier (barcode). A Member who takes the initiative to open an account or create a complete enrollment profile on the Milliplein.com website undertakes to take all necessary steps to prevent anyone from accessing his or her account, password, username, and/or personal identifier. The Member is solely responsible for maintaining the confidentiality of his or her Milliplein card and account as well as any password, username, or personal identifier associated with his or her account and may not authorize anyone else to use it.

Loss or theft of a card: In the event of loss or theft of a Milliplein card, the Member must notify Milliplein Program Customer Service during business hours by calling 418-688-1533 in the Quebec City area or toll-free 1-844-228-1533 outside Quebec City. Members may also report a lost or stolen card on the Milliplein.com website in the section reserved for members. The Member must specify the number of the lost card as well as his or her name and address. Fernand Dufresne Inc. will issue a new Milliplein card, together with any additional cards requested, and will transfer the balance of Milliplein Points earned when the new card number is issued. Fernand Dufresne Inc. cannot be held responsible for transactions made in the account between the time the card was lost or stolen and the time Fernand Dufresne Inc. was notified by the Member.

Acceptance: By registering for the Milliplein Program, the Member agrees to receive occasional promotional and advertising offers from the Milliplein Program or participating partners by email, mail, or telephone. The Member is entitled to unsubscribe at any time by contacting Fernand Dufresne Inc. in the manner set forth in these Terms and Conditions.

2) Earning Points

Initial reward: Milliplein Points awarded free of charge when creating the complete online enrollment profile on the Milliplein.com website are only awarded once to the main Member.

Earning Points: Milliplein Points are earned based on the price before taxes of an eligible product or service purchased from a participating partner. In order to earn Milliplein Points, the Member must present his or her Milliplein card before completing an eligible product or service purchase with a participating partner. The Member will not earn additional Milliplein Points after a transaction has been completed, particularly if the Member has omitted or forgotten to present his or her Milliplein Card before completing a transaction.

Exclusions: Certain purchases may not be eligible for earning Milliplein Points. In particular, no Milliplein Points will be awarded on the purchase of tobacco products, gift certificates, gift cards, prepaid cards, postage stamps, certain other products or services excluded by participating partners, purchases resulting from the redemption of Milliplein Points, or purchases of any other product or service for which the awarding of Points, rebates, or discounts is prohibited by law.

Value of Points: The number of Milliplein Points issued per dollar purchased before taxes under the Milliplein Program may differ depending on the line of business, and a minimum purchase may be required to earn Points. The number of Milliplein Points issued per dollar purchased may be adjusted periodically to reflect various factors, including inflation or price increases, depending on the line of business.

Cancellation of Points: All or part of the balance of Points in a Member’s Milliplein account may be debited as a result of a fraudulent or ineligible transaction or at the request of a participating partner following the cancellation or correction of a purchase or if a product is returned.

Statements: The Milliplein Points earned during a purchase transaction appear on the receipt or invoice issued by the participating partner and it is the Member’s responsibility to verify their accuracy. All transaction statements in a Member's Milliplein account are considered accurate. The Member must prove any discrepancy or inaccuracy and notify Fernand Dufresne Inc. within sixty (60) days of the purchase. It is the Member’s responsibility to keep all supporting documents regarding the purchase of goods or services on which Milliplein Points can be earned. The Member may also consult his or her transaction statement or earned points balance at any time in the Members section of the Milliplein.com website.


3) Redemption of Points

Eligibility: Reward Points in a Member’s Milliplein account may only be redeemed for gasoline at participating gas stations and for purchases of goods and services from authorized partners who allow the redemption of Points. Otherwise, reward Points cannot be redeemed for cash, gift cards, or prepaid cards or paid into a credit card or debit account other than a fuel-saving card issued by Fernand Dufresne Inc. or a gift card specifically issued under the Milliplein Program by a participating partner.

How it works: The Member must to redeem his or her Points at a participating partner before paying for a product or service. The Member must give his or her Milliplein card to the participating partner at the time of the transaction. The monetary value of the Points redeemed will be applied to the retail price displayed at the time of redemption for the type of product and service at a participating partner, it being understood that it may not exceed the purchase price of any product or service. In addition, Fernand Dufresne Inc. and its participating partners reserve the right to establish, at any time, a minimum and maximum monetary value when Milliplein Points are redeemed.

Restrictions: The Member agrees that Points can be redeemed only once a day. The Member agrees that Milliplein Points cannot be redeemed when Fernand Dufresne Inc. or a participating partner’s computer system is down or under maintenance.

Taxes: Any sales tax or other tax that must be added to the total purchase price of a product or service remains applicable when redeeming Points. The Member may redeem the corresponding amount of Points earned to pay the purchase price as well as the corresponding amount of any applicable tax when redeeming Points.

4) Expiry of Points

The Member understands and agrees that his or her participation in the Program must be continuous and regular and that Fernand Dufresne Inc. will be entitled to close any account of a Member that has been inactive for a period of twenty-four (24) months or more, regardless of the reason, i.e., a period of twenty-four (24) months without adding or redeeming Points in the Member’s account. Upon expiry of the time limit, Fernand Dufresne Inc. will be entitled to delete the Points in the Member’s account.

5) Special conditions

Enrollment profile update: The Member agrees to update his or her enrollment profile and to keep track of any changes in address or email by either entering them online or contacting the Milliplein Program Customer Service Department.

Personalized offers and promotions: The Member may obtain personalized offers as well as temporary promotions for earning and redeeming Points. The Member acknowledges and accepts that these offers and promotions are subject to limited terms and conditions.

Points non-transferable: The Member cannot transfer the Points he or she has earned to another person.

6) Program changes or termination

Amendments: Fernand Dufresne Inc. reserves the right to amend the Terms and Conditions of the Milliplein Program at any time upon a minimum of thirty (30) days’ notice prior to the coming into force of any proposed change. It is agreed that amendments to the Program may include, but are not limited to, the following:

  • Eligibility requirements for participation in the Program
  • Method of and conditions for earning Points
  • The extent of purchases of eligible goods and services for earning and redeeming Points, including any purchase restrictions on the earning of Points and any minimum or maximum purchase amount for earning and redeeming Points
  • The method of redeeming Points and the conditions under which they can be redeemed
  • Adding or deleting participating partners
  • The value of reward units or the change in the basis of conversion of reward units
  • The applicable time limit for the expiry of Points or any condition that may lead to the closure of a Member’s account
  • Conditions under which Points may be transferred from a Member to another person

A notice of amendments to the Program Terms and Conditions may be posted online on the Milliplein.com website or in-store, or transmitted by email and/or mail. The notice of amendments will indicate any new and amended provisions of the Terms and Conditions and the date on which the amendments become effective.

Termination: In the event that Fernand Dufresne Inc. decides to terminate the Program, the Member will receive sixty (60) days’ notice informing him or her of termination of the Program and giving him or her the opportunity to redeem the balance of his or her Points.

7) Termination or cancellation of the account

Fernand Dufresne Inc. reserves the right to revoke the Member’s enrollment or terminate or cancel his or her account if it is discovered that the Member does not meet the eligibility requirements of the Program or does not comply with the Terms and Conditions. All Member Points will then be permanently deleted.

8) Limitation of liability

Fernand Dufresne Inc. cannot be held liable for losses, errors, or omissions under the Milliplein Program. Fernand Dufresne Inc. cannot be held liable for any costs, fees, losses, costs, damages, delays, or incidents (including compensatory, incidental, indirect, punitive, or exemplary damages or damages resulting from loss of revenues or profits) that may arise directly or indirectly from: (i) unauthorized use of the Member’s Milliplein Card or access to the Member’s online account; (ii) any offer, representation, declaration, or claim made by a Participating Partner regarding the Program or the products or services of a Participating Partner (including their quality); or (iii) the redemption of Points, or the purchase or use of products or services of Participating Partners. The sole liability of Fernand Dufresne Inc. towards the Member or any other person benefiting from Points earned by the Member, regardless of the circumstances, whether due to negligence, breach of contract, or otherwise, will be limited to adding the number of Points used in such circumstances, if any, to the Member’s account.

9) Personal information and email communications

Fernand Dufresne Inc. takes all reasonably necessary measures to comply with applicable legislation in Quebec and Canada regarding the protection of personal information. For this reason, the Program and its Terms and Conditions are governed by Fernand Dufresne Inc.’s privacy policy, which is intended to inform the Member of the nature of the personal information that may be collected, used, and disclosed to third parties, if any. The privacy policy provides a mechanism for Members to have access to their personal information and to correct such information, as needed. The Member can access Fernand Dufresne Inc.’s privacy policy by clicking the following hyperlink: Privacy Policy. Fernand Dufresne Inc. is authorized to contact the Member by email or electronic means, including to inform him or her about the Program, any new features, Points earned and redeemed, as well as offers and promotions offered under the Program. These communications may be considered commercial electronic messages (“CMEs”) within the meaning of Canada’s anti-spam legislation (“CASL”) and its regulations. Although it may be exempted by CASL from requesting consent under CASL for sending a CME, depending on the circumstances, it is Fernand Dufresne Inc. policy to request the Member’s explicit consent prior to sending a CME and to allow the Member to unsubscribe at his or her discretion from CMEs from Fernand Dufresne Inc. by clicking the unsubscribe hyperlink or by sending an email to info@milliplein.com or calling the phone number below. If the Member is of the opinion that he or she has received a CME from Fernand Dufresne Inc. and should not have received it, he or she must immediately contact the person in charge using the contact information below, and Fernand Dufresne Inc. will take the necessary steps to quickly correct the situation (i.e., within ten [10] business days).

Personalized advertisements and offers: By enrolling, the Member agrees that certain personal information that he or she provides when enrolling or updating his or her profile may be shared with Program partners so that special promotions or advertisements of interest to him or her may be made available. Members may withdraw their authorization at any time in the Members-only section of the Milliplein.com website or by emailing info@milliplein.com or by calling the telephone number below.


10) General provisions

The Terms and Conditions are subject to the following general provisions:

Applicable laws and choice of residence: These Terms and Conditions and their interpretation, performance, validity, and effect will be governed by the laws of Quebec and any applicable federal laws. The parties agree that any dispute arising out of or resulting from these Terms and Conditions will be brought before the competent court in the judicial district of Quebec.

Notices and disclosure: Notices required or permitted under these Terms and Conditions must be in writing and will be deemed to have been validly given if sent by email or registered mail to the following address:
